The Physician Prosperity Program® includes a complete, fixed fee, physician contract review with a detailed letter of our recommendations for you to give to your potential employer. All of our packages include an MGMA compensation and benefits analysis. All contract reviews are personally performed by our experienced attorneys and completed within 3 business days.

Frequently Asked Questions

Almost all health systems and private practices will make changes to your agreement, no matter what the recruiter tells you. In the 40 years that we have served as physician contract lawyers, we have only had a handful of employers refuse to make changes. In the rare instances where the employer refuses to make contractual changes following our recommendations in the Physician Prosperity Program®, you can often increase the salary or benefits by pointing out discrepancies between the offer and MGMA benchmarks.

As part of the Physician Prosperity Program®, we would include review of a letter of intent or term sheet at no additional charge.

No, there are no hidden fees in the Physician Prosperity Program® when you hire your personal physician contract lawyer. Each package describes exactly what you get. You always have unlimited consultations with your personal physician contract lawyer until the original physician contract review letter is ready to be submitted to your employer. If you choose the negotiation package, you receive unlimited consultations, and your personal physician contract lawyer will take whatever time is necessary to achieve the best contract obtainable, no matter how many iterations it takes with the employer’s counsel.

Yes, we review agreements in every specialty recognized by MGMA (and some specialties that are not yet recognized by MGMA).

 

If you invest in one of the Physician Prosperity Program® physician contract review packages, you will deal directly with Dennis Hursh, a physician contract lawyer who will be your exclusive contact. Dennis has over 40 years of experience in physician contract review.

Your personal physician contract lawyer will deliver the initial contract review letter 3 business days after you have invested in one of the Physician Prosperity Program® physician contract review packages. 

Yes, you can purchase an MGMA analysis only. We would treat an MGMA analysis as a single issue.  You can get started on the review here.

We recommend that you choose the offer that your “gut” tells the is the one you want, and only invest in the physician contract review package for that offer. Physicians frequently are reluctant to pursue the offer that is most attractive to them, especially if another offer has higher compensation.

In fact, there is no such thing as a “free lunch.” A position that offers higher compensation will likely require more patient contact hours, call coverage, etc. We recommend focusing on only one offer. You can usually delay responding to the other offers, informing them that you have retained a physician contract lawyer and the lawyer cannot respond for two or three weeks. This should give you time to evaluate the response from your chosen employer to our physician contract review letter.

If you choose to have us review multiple agreements, we do provide a 10% discount on the second review.

We have extensive experience in reviewing private practice employment agreements, and these agreements are included in the Physician Prosperity Program®. You can see some of the issues to be aware of here.

However, we have found that if you tell the employer that your physician contract lawyer can’t review the contract for two weeks, most employers will give you an extension. Two weeks allows time for you and your personal physician contract lawyer to massage the contract review letter to your liking, and still deliver it to the employer before you promised it.

That is a good question! Our 40 years of experience has taught us that each contract is unique, and presents its own special issues. You can check our blog to see some of the issues that arise in physician contract review. The classic lawyer answer – it depends.  After we review their changes, sometimes the physician is satisfied and ready to sign. The agreement won’t be perfect from your perspective, and it won’t ever be.  If there are major issues that they didn’t address, or address in a way that brings you comfort, sometimes negotiations occur.  When we go over the revisions, I will highlight the significance of what they did and didn’t address, and many of the “nice to have” issues can be ignored. If there are still major items you are concerned about, negotiations may follow. In our call discussing their revisions I will tell you about some of the issues that frequently are not changed, to help you decide if there are further points you want to raise with the employer.

However, we have found that if you tell the recruiter that your physician contract lawyer can’t review the contract for two weeks, most recruiters will give you an extension. Physician Prosperity Program


How It Works

After purchasing the physician contract review, you will receive an email asking you to transmit the agreement and any concerns you have to me. Many physicians do this by email, but I will be available by phone, too. In three business days from the time you purchase the Physician Prosperity Program® and transmit the draft physician employment agreement along with any concerns you have about the agreement and the information I will need to perform the MGMA analysis, you will receive a detailed physician contract review letter from me.

After you receive my physician contract review letter, you will have the opportunity to discuss it with me, to make sure all of your concerns were met, and to correct any factual inaccuracies, or to point out things that were verbally promised but didn’t make it into the physician employment agreement. These discussions, and revisions of the letter following these discussions, are included in the initial fixed fee.

Once you are completely comfortable with the physician contract review letter, you transmit the letter to your potential employer.
